2009/2010 State Fiscal Year Budget for New York State Impact on New York Health Care Reform Act (HCRA)

Changes to the New York Health Care Reform Act (HCRA) of 2000 were made as a part of the 2009-2010 New York State fiscal year budget. Surcharge percentages imposed on payments to New York State general hospitals and to New York diagnostic and treatment centers that provide comprehensive primary care or ambulatory surgery services provided on or after April 1, 2009 will be increased as follows:

  • From 8.95% to 9.63%.
  • From 6.54% to 7.04%.
  • Non-elector additional surcharge: from 26.26% to 28.27%.

Employers should make note of the above increases; however, no action is required by employers who have elected to make public goods payments directly to the Department of Health's Pool Administrator via Meritain Health. Meritain Health will continue to make those payments on your behalf. If Meritain Health does not make payments on your behalf, you should make note of the above increases and take action accordingly.
