Oregon Members Right to Request Confidential Communications

Under federal HIPAA requirements, members already have the right to request certain restrictions on the way their health plan uses or discloses their Protected Health Information (PHI).

In addition to this right under HIPAA, the state of Oregon now requires that carriers and third party administrators allow members who reside in the state request to have certain PHI redirected to them when it is requested by another person. Plan sponsors are required to make their members aware of their right to request confidential communications.

If you are a member residing in Oregon, you may submit your request for confidential communications by completing the standardized form entitled Oregon Confidential Communication set forth on the Insurance Division website of the Department of Consumer and Business Services.

Members can mail or fax their request to the address listed on the back of their ID cards. A written letter or email will be accepted, provided all necessary information is received to properly process the request. Members may also submit their request over the phone by calling the customer service number on the back of their member ID Card.
